Auto Top-Up Conditions

Auto Top-up and Direct Debit or Credit Card Agreement
By setting up an Auto Top-up via Direct Debit or Credit Card, I authorise automatic, recurring charges against the bank account or credit card specified, to pay for the transaction value, products indicated and any fees or charges, and agree to the following terms and conditions.

  1.   I am at least eighteen (18) years of age.
  2.   All information provided by me when registering my Vix Smartsite SmartSite card and completing the Auto Top-up form is true, accurate and complete.
  3.   I authorise Vix SmartSite (operator of the Vix Smartsite Loyalty Program) to verify the information contained in this Auto Top-up Authorisation.
  4.   If the bank account or credit card account specified herein is closed or is otherwise terminated, the Auto Top-up authorised herein may be terminated, at the sole discretion of Vix.
  5.   I will promptly update my SmartSite details with any changes to my name, email address, telephone number(s), credit card information, bank account information and any other information provided in setting up this Auto Top-up Authorisation.

Direct Debit Terms
The terms and conditions under this heading apply to Auto Top-up by Direct Debit only
  1.   This Auto Top-up Authorisation shall take effect upon set up of the Auto Top-up via Direct Debit and shall remain in effect unless terminated or changed as provided herein. A Direct Debit Request, for the amount I have requested, will be sent to my bank when my card balance falls below $20. If this occurs on a non-business day, the transfer will occur on the next business day.
  2.   I will ensure that I have sufficient funds in my nominated savings/cheque account on the direct debit deduction date to cover the amount of the Auto Top-up value. If there are insufficient funds in my account on the direct debit deduction date, my bank, building society or credit union may charge a fee that I will be obliged to pay.
  3.   I may terminate or modify the details of this Auto Top-up Authorisation online by logging into my account at smartsite.vixtechnology.com/VIXSmartSite and selecting the Top-up - > Auto Top-up menu, make changes to my Auto Top-up Authorisation or select "I would like to disable my Auto Top-up" to terminate my authorisation, then Update Auto Top-ups.
  4.   The Auto Top-up termination or alternations will be actioned within five (5) business days after the date of submission of the request. If I change from Auto Top-up via Direct Debit to Auto Top-up via Credit Card, a new Auto Top-up agreement is entered into and the conditions laid out under the heading "Credit Card Terms" below shall govern in place of the terms and conditions under "Direct Debit Terms". There is no charge to change methods. Any triggered Auto Top-ups during this period (5 days) may still reflect the agreement before the changes were made and will attract the fees and charges of the previous agreement.
  5.   If a bank transaction authorised hereunder is rejected, reversed or otherwise fails to cover the price of an Auto Top-up value or product, Vix may, in its sole discretion, block the use of the value or product to prevent its further use, terminate the Auto Top-up authorised herein, or both. Under any circumstance, the member is liable for payment of the Auto Top-up value or product if the bank transaction failed to cover the price.
  6.   If there are insufficient clear funds in your account:
    (a) you may be charged a fee and/or interest by your financial institution;
    (b) you may also incur fees or charges imposed or incurred by Vix; and
    (c) you must arrange for the debit payment to be made by another method or arrange for sufficient clear funds to be in your account by an agreed time so that Vix can process the debit payment.
  7.   If an Auto Top-up is terminated due to failure of a bank transaction to cover the price of an Auto Top-up product, you may submit a new Auto Top-up Authorisation online.
  8.   Direct Debit Accounts
    You should check:
     a) With your financial institution to find out whether direct debiting through the bulk electronic clearing system (BECS) is available for your account, as direct debiting is not available on all accounts offered by financial institutions;
     b) Your account details against a recent account statement to ensure they are correct;
     c) With your financial institution, if you are unsure how to complete the account details on the Direct Debit Request (DDR).


Credit Card Terms
The terms and conditions under this heading apply to Credit Card Auto Top-ups only.
  1.   This Auto Top-up Authorisation shall take effect upon set up of the Auto Top-up via credit card and shall remain in effect unless terminated or changed as provided herein. The Auto Top-up amount I have specified will be loaded automatically to my SmartSite card, and the supplied credit card will be charged when the current balance on my SmartSite card is insufficient to pay for my purchase.
  2.   All credit card transactions will attract a 2% processing fee that will be added to the Auto Top-up amount. The credit card charge will include the processing fee. The Auto Top-up Payment form will include and indicate the 2% processing fee. The Auto Top-up amount loaded to your loyalty card will be the requested top-up amount, excluding the 2% processing fee.
  3.   I may terminate or modify the details of this Auto Top-up Authorisation online by logging into my account at smartsite.vixtechnology.com/VIXSmartSite and selecting the Top-up - > Auto Top-up menu, make changes to my Auto Top-up Authorisation or select "I would like to disable my Auto Top-up" to terminate my authorisation, then agree to the Terms and Conditions and click "Update Auto Top-up". Changes will not take effect unless you click "Update Auto Top-up".
  4.   The Auto Top-up termination or alternations will be actioned within five (5) business days after the date of submission of the request. If I change from Auto Top-up via Credit Card to Auto Top-up via Direct Debit, a new Auto Top-up agreement is entered into and the conditions laid out under the heading "Direct Debit Terms" above shall govern in place of the terms and conditions under "Credit Card Terms". Any triggered Auto Top-ups during this period (5 days) may still reflect the agreement before the changes were made and will attract the fees and charges of the previous agreement.
  5.   If the credit card authorised hereunder is rejected, reversed or otherwise fails to cover the price of an Auto Top-up value or product, Vix may, in its sole discretion, block the use of the value or product to prevent its further use, terminate the Auto Top-up authorised herein, or both. Under any circumstance, the member is liable for payment of the Auto Top-up value or product if the credit card transaction failed to cover the price.
  6.   If an Auto Top-up is terminated due to failure of a credit card transaction to cover the price of an Auto Top-up product, the member may submit a new Auto Top-up Authorisation online.

Changing the Agreement
Vix can change any of the terms of this agreement at any time by giving at least 30 days’ notice of the change. Changes to this agreement will be posted on the Vix Smartsite Loyalty website at https://smartsite.vixtechnology.com/VixSmartSite. You may also request a written copy of these terms and conditions by sending an email request to ANZ.ServiceDesk@vixtechnology.com.

Disputes
If you believe there has been an error in debiting your account you should contact us by email on ANZ.ServiceDesk@vixtechnology.com or by telephone between 8:30am and 5pm (AWST) on +61 (0)8 6180 4600. If we conclude that your account has been incorrectly debited we will arrange for your account to be reimbursed with the incorrectly debited amount. If we conclude that your account has not been incorrectly debited we will provide you with reasons and evidence of this finding.

Privacy Policy and Confidentiality
Our privacy policy may be seen on our website https://smartsite.vixtechnology.com/VixSmartSite. We will keep information about your financial institution account confidential except to the extent necessary to resolve any claim you may make relating to a debit which you claim has been made incorrectly, or as otherwise required by law.

Cash Balance
If I have selected to authorise Auto Top-up of a cash balance, the amount I have specified will be loaded automatically to my Membership card, and the specified bank account or credit card will be charged, when the current cash balance on my Membership card falls below a threshold of $20 (twenty dollars).
CAUTION: An Auto Top-up of a cash balance will not be performed more than once per day. No withdrawal facility is possible on this balance.
